Terms and Conditions

Welcome to Images by Conway (“Company,” “we,” “us,” or “our”). These Terms and Conditions govern your use of our website, services, and products (“Services”). By accessing or using our Services, you agree to comply with and be bound by these Terms. If you do not agree, please do not use our Services.
1. General Information
Images by Conway provides professional photography services, image products, and related digital content. All bookings, purchases, and use of our photos are subject to these terms.
2. Intellectual Property Rights
All photographs, videos, logos, graphics, and written content created by Images by Conway remain the intellectual property of the Company unless otherwise agreed in writing. Clients receive limited rights for personal or commercial use as specified in their service contract or invoice. Unauthorized reproduction, distribution, or modification of our work is strictly prohibited.
3. Booking and Payments
- A non-refundable deposit may be required to secure a booking.
- Remaining balances are due prior to or on the date of the scheduled session unless otherwise agreed.
- Failure to pay may result in cancellation of the booking or withholding of images.
4. Cancellations and Rescheduling
Cancellations made 5 days or more prior to the scheduled session may be eligible for rescheduling. Cancellations made less than 2 days before the session may forfeit the deposit.
Images by Conway reserves the right to reschedule sessions due to unforeseen circumstances such as illness, weather conditions, or equipment failure.
5. Image Delivery and Editing
Images will be delivered within 7 business days following the session unless otherwise stated in the contract. Editing style and artistic approach are at the discretion of the photographer. Requests for additional edits may incur extra charges.
6. Client Usage Rights
Clients may use delivered images for the purposes agreed upon in writing. Any other use—including selling, sublicensing, or entering into competitions—without prior consent from Images by Conway is prohibited.
7. Model Release
By participating in a photoshoot, clients grant Images by Conway permission to use selected images for marketing, portfolio, and promotional purposes unless otherwise requested in writing before the session.
8. Limitation of Liability
Images by Conway shall not be liable for any indirect, incidental, or consequential damages resulting from the use or inability to use our services or images. Our total liability shall not exceed the amount paid for the applicable service.
9. Privacy Policy
We respect your privacy. Personal information collected will only be used for business purposes and will not be shared with third parties without consent, except as required by law.
10. Governing Law
These Terms are governed by the laws of South Australia, Australia. Any disputes arising from these Terms shall be resolved in the courts of South Australia.
